Terms and Conditions of Sale – Elevage du Paradis des Edelweiss

Article 1 – Purpose and Reservation Process

• Online Reservations: The reservation process and customer relationship management are handled digitally through our partner, Digital Nelyx.

• Confirmation: A reservation is considered final upon receipt of the deposit and the sending of an automatic or manual confirmation generated by the Digital Nelyx system.

Article 2 – Required Documents

Upon delivery of the puppy, the Buyer will receive:

1. A proof of sale (invoice).

2. A veterinary health certificate (issued within the last 3 months).

3. The information sheet on the dog's characteristics and needs.

4. The health record or European passport.

5. The ICAD ID card.

6. The birth certificate (LOF) or the acknowledgment of receipt from the SCC.

7. The Certificate of Commitment and Acknowledgment: This document must be signed by the Buyer at least 7 days before the transfer. Otherwise, the sale cannot take place.

Article 3 – Price and Payment

• Rates: Prices are listed in euros and are final at the time of booking.

• Payment Methods: The farm accepts bank transfers, cash (up to the legal limit), and secure credit card payments through the website’s integrated payment platform.

• Deposit: A deposit is required to secure the reservation of a puppy. This deposit is non-refundable in the event of unilateral cancellation by the Buyer (except during the statutory cooling-off period, if applicable).

Article 4 – Retention-of-Title Clause

The puppy remains the legal property of the Seller until the purchase price has been paid in full. However, the transfer of risks (health, accidents) takes effect upon physical delivery of the animal to the Buyer.

Article 5 – Intended Use of the Animal and Warranties

• Intended Use: Unless otherwise specified in writing, the puppy is sold as a companion animal. No guarantees are made regarding performance in competitions, working, or breeding.

• Defects That Void the Sale: The sale is protected by Articles L.213-1 et seq. of the Rural Code (parvovirus, distemper, etc.) in accordance with the statutory time limits.

• Warranty of Conformity: The provisions of Articles L.217-1 et seq. of the Consumer Code apply.

Article 6 – Communication and Automations

By using the services on our website, the Buyer agrees to receive communications (emails, text messages) related to their order or to the farm’s operations. These messages are managed using Digital Nelyx’s automation tools. The Buyer retains the right to unsubscribe via the links included in each message.

Article 7 – Personal Data (GDPR)

Personal information is stored on the secure servers used by Digital Nelyx on behalf of Élevage du Paradis des Edelweiss. It is strictly reserved for internal use and administrative compliance (ICAD, SCC).

• They are securely stored in our CRM (Digital Nelyx).

• They are never sold to third parties.

• The Buyer has the right to access and delete their data by contacting: leparadisdesedelweiss@orange.fr.

Article 8 – Obligations of the Buyer

The Buyer agrees to treat the animal with respect, to meet its physiological and behavioral needs, and to comply with mandatory veterinary care. Any mistreatment may result in legal action and a report to the appropriate authorities.

Article 9 – Disputes and Mediation

In the event of a dispute, the parties shall seek an amicable resolution. The Buyer is informed that he or she may, free of charge, refer the matter to the consumer mediator approved by the breeder:

Article 10 – Reputation and Social Media

The Buyer agrees not to damage the reputation of Élevage du Paradis des Edelweiss on social media or review platforms without first attempting to reach an amicable resolution with the breeder.
